Terms of Use and Privacy Policy

Area of Application

Below we provide information about the collection of personal data during use of the website www.eckold.com including other domains that lead on to this domain, such as www.eckold.ch. These provisions also apply to our webshop under the domain name https://shop.eckold.ch. In addition, this Privacy Policy also applies to any personal data that ECKOLD AG acquires knowledge of in the course of its normal business activities. We collect, process and use your personal data in accordance with the content of this Privacy Policy and the applicable data protection provisions, in particular the Swiss Data Protection Act (DSG) and the revised Swiss Data Protection Act (revDSG) and the EU General Data Protection Regulation (GDPR). We take privacy very seriously and always treat your personal data confidentially and in accordance with applicable legal requirements. Please bear in mind that all data transmission over the Internet is potentially exposed to security vulnerabilities. Personal Data

Personal data is all information that relates to a natural person. A data subject is a person about whom personal data is processed. Processing includes any operation carried out with or without the aid of automated procedures, such as the collection, recording, organisation, storage, modification, retrieval, consultation, use, disclosure, linking or erasure of personal data. This Privacy Policy explains what data is collected and what we use it for.


Data Categories and Purpose of Processing

We process various categories of personal data, such as master data, contract data, communication data, registration data and technical data. You provide us with most of this data yourself, so that we can agree on and process a transaction with you as a customer, supplier or other business partner. We obtain other data from publicly accessible sources, such as the Internet, debt collection registers and commercial registers. We only process personal data to the extent necessary for communication between you and us, enquiry and order processing, registration, relationship management and marketing purposes. Please note that our emails are sent unencrypted and are only secured by the connection encryption operating between Microsoft 365 accounts. For the benefit of both of us, we store personal data in our ERP system, so that it will be available directly for further transactions. As part of the job application process, the HR Department or Division Management collects personal data, which will be treated as strictly confidential and will be used only to assess your suitability for employment with us. Without your consent to the use of this personal data for subsequent vacancies, your entire application file, apart from your name and address, will be deleted no later than three months after the application process has completed.


Your Rights

You have the option of obtaining information from us about any personal data of yours that we store (origin, recipient, purpose of processing) and, if necessary, to request the correction or deletion of that data. If you have given your consent to the processing of your data, you can revoke that consent at any time.


Data Transfer to Third Parties

If we disclose your personal data to third parties in order to fulfil the contract between us or to comply with legal provisions or to protect our interests, we will observe legal requirements and conclude appropriate agreements with the recipients of the data, so as to protect your data.


Security Measures

To protect your personal data, we have industry-standard IT and network security solutions in place, which are kept up to date, as well as access restrictions. Our employees are trained in correct behaviour that should be adopted in the event of potential hazards.


Profiling

We do not generally use automated decision-making or profiling.


Access Data

Accessing the site causes so-called "server log files" to be created and stored. The following data is logged in this way: Visited website

Server log files are never merged with other personal data. Server log files are collected and analysed by our contract processors (IT service providers) in order to administer and improve the website and to detect and prevent unauthorised access. The server log files with the above-mentioned data are deleted after six months at the latest, unless there is a legitimate interest or a service-oriented request. We reserve the right to store the server log files for longer if there are factual circumstances that suggest unauthorised access.


SSL/TLS Encryption

This website uses SSL/TLS encryption for security reasons and to protect the transmission of confidential content, such as the enquiries you send to us as the site operator. You can always recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.


Adobe Fonts

We use Adobe Fonts for the visual design of our website. Adobe Fonts is a service provided by Adobe Systems Incorporated, 345 Park Avenue, San Jose, CA 95110-2704, USA, which grants us access to a font library. To integrate the fonts we use, your browser must create a connection to an Adobe server in the USA and then download the font required for our website. Adobe thereby receives the information that our website has been accessed from your IP address. On this website we use MyFonts Counter, a web analysis service of MyFonts Inc, 500 Unicorn Park Drive, Woburn, MA 01801, USA. Due to the licence terms, page view tracking is carried out by counting the number of visits to the website for statistical purposes and transmitting them to MyFonts. Cloudflare

Our website uses a so-called Content Delivery Network (CDN) from the technology service provider Cloudflare Inc, 101 Townsend St. San Francisco, CA 94107, USA. A CDN is an online service that is primarily used to deliver large media files, such as graphics, page content or scripts through a network of regionally distributed servers connected via the Internet. The use of Cloudflare's CDN supports our website in optimising loading speeds. Technically, the data transfer between your browser and our website is routed via the Cloudflare network. Cloudflare is able to analyse the data traffic between users and our website in order to detect and ward off attacks on our services, for example. Cloudflare may also store cookies on your computer for analysis and optimisation purposes. Cloudflare is used in accordance with Art. 6 para. 1 lit. f GDPR on the basis of our legitimate interest in the secure and efficient provision and improvement of the stability and functionality of our website. Newsletters

On this website we offer you the opportunity to subscribe to our newsletter. To do this, please fill out the corresponding form. Among other things, you provide your e-mail address, which allows us to verify that you are the owner of the e-mail address provided and that you agree to receiving newsletters. We use the European newsletter provider Sendinblue GmbH (Brevo), Köpenicker Strasse 126, DE-10179 Berlin for this review and for the creation and dispatch of newsletters. Naturally, the e-mail addresses must be uploaded to the provider's platform. The provider is obliged to comply with currently valid data protection provisions. No additional data is collected. Contact Form

The data you enter will be sent as an e-mail to our mail server. We will process your enquiry and get in touch with you. From then on, our general guideline regarding the handling of personal data stated above will apply. All personal data from the digital contact form will be deleted from our web servers within 24 hours.


Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. We can use the statistics obtained to improve our offer and make it more interesting for you as a user. This website also uses Google Analytics for a cross-device analysis of visitor flows, which is carried out via a user ID.
